"Failure is not an option."
Attorney General Eric Holder
The top law enforcement officer of the United States Government opines after "careful and agonizing study," the constitutional considerations of the KSM trial.
He is sure about that? Listen to the clip above where Senator Graham leaves him speechless after posing a simple question. (Don't let the length deter you, the "money shot" occurs in the first 25 seconds although the entire clip is a fascinating study of incompetence regarding our AG). Again, I've said many times I'm not a lawyer, but isn't due process built upon the premise of innocence until guilt is judged and rendered by the people?
Now to make matters worse, we have a constitutional law professor (he calls himself a "constitutional scholar") who went on the record with the following comments...
There are some who predict KSM has already been given "his free pass" to acquittal due to these reckless comments and decisions from the Justice Department and the White House.
Charles Krauthammer writes a hard-hitting essay on this topic and is worth your time to read here.

So what's Graham's alternative plan exactly, and why hasn't it been done?
KSM has been sitting there for years, and now that we're moving forward toward executing him, Republicans are in freak out mode.
What exactly do they propose to do instead? Just shoot him? What have they been waiting for? They controlled every branch of government for almost 8 years!
This is similar to Republicans complaining now about the deficit, after having done precisely nothing about it for the past 8 years.
This is similar to Republicans complaining about immigration, after having done precisely nothing about it for the past 8 years.
Healthcare? Nothing happened in the past 8 years.
Social Security? Nothing happened in the past 8 years.
Did anything happen the last 8 years?
And here, Republicans again are complaining now that something has been proposed and is moving forward.
Lead, follow, or get out of the way.
Republicans proved the last 8 years they can accomplish exactly nothing when in power.
